Wendy’s Mobile Apps Policy

Welcome to Wendy’s® Mobile App. A reference to “Wendy’s,” “our,” “we,” or “us” includes Wendy’s International, LLC and each of its related, affiliated, parent or subsidiary companies.  In addition to the terms of the Wendy’s Privacy Policy, this Mobile Apps Policy (this “Policy”) explains how Wendy’s may process personal information for online services accessed from mobile devices (“Mobile Apps”). This applies to all Wendy’s Mobile Apps that link to this Policy. Downloading a Wendy’s App will constitute your consent to this Policy, our Privacy Policy, our Terms of Use, our Career Submission Policy and all related policies. Further, you agree that we may rely upon any consents or agreements you provide to any App stores (e.g., Apple iTunes Store or Google Play). Please note that this is a general overview of what information may be processed, and additional specific notices and terms will be applied within specific Mobile Apps where appropriate and/or required by law.

  1. INFORMATION WE COLLECT AND HOW WE USE IT

    For Mobile Apps, we may collect information about the device you use to access the Mobile App. We have set out the types of information we collect and how that information is used in the table below. The information collected will depend on the functionality of the specific Mobile App you are using, and additional information may be collected through the Mobile App as specified in the Mobile App.
     

    Type of information How is it used?
    Unique Device Identifier A unique device identifier is a series of numbers and letters assigned to your device. We may associate the unique device identifier with other information and will treat the combined information as personal information in accordance with this Policy for as long as it is combined. We may use the unique device identifier associated with equipment, including your device’s advertising identifier, or systems used in connection with your device (e.g., an identifier of a Wi-Fi router or Internet access point).
    Location information When you use one of our location-based services, we may collect and process information about your precise past or current location and where you have gone. Some Mobile Apps and other online services require your location information for their features to work. Where a Mobile App does collect precise information about the location of your device, it will be used to provide requested location services and, depending on the particular Mobile App, it may be used to allow tagging or to check-in, among other uses. Please refer to the instructions included in the Mobile App for information about how to opt-out of providing location information, or contact privacy@Wendys.com.

    The location-based services offered in connection with our Mobile Apps are for individual use only and should not be used or relied on as an emergency locator system, used while driving or operating vehicles, or used in connection with any hazardous environments requiring fail-safe performance, or any other situation in which the failure or inaccuracy of use of the location-based services could lead directly to death, personal injury, or physical or property damage. The location-based services are not suited or intended for family finding purposes, fleet tracking, or any other type of business or enterprise use – other products exist today that may be used specifically for these purposes.
    Log Information When you use the Mobile App or view content on our website, we may automatically collect and store certain information in server logs, including, but not limited to, internet protocol (IP) addresses, device information, internet service provider (ISP), clickstream data, browser type and language, viewed and exit pages and date or time stamps. We may use log information as specifically indicated in the Mobile App, as well as to assess the performance of our Mobile App or other online services, prevent fraud, provide technical support, conduct research, generate analytics, address internal online services operations and/or respond to your needs.
    Unique Mobile App Numbers When you install or uninstall a Mobile App containing a unique Mobile App Number or when such a service searches for automatic updates, that number and information about your installation, such as the type of operating system, may be sent to us. We may use the Unique Mobile App Numbers as specifically indicated in the Mobile App, as well as to assess the performance of our Mobile App or other online services, prevent fraud, provide technical support, conduct research, generate analytics, address internal online services operations, and/or respond to your needs.
    Information You Submit through the Mobile App When you register with us and use a Mobile App, you may provide us with certain information, including: (a) your name, email address, age, user name, password and other registration information; (b) transaction-related information, such as when you make purchases, use or load certain gift card information, respond to any offers, or download or use Mobile Apps from us; (c) information you provide us when you contact us for help; (d) credit card information for purchase and use of the Mobile App; (e) menu selections to remember meal preferences or learn about nutritional information; (f) preferences related to offers and incentives that we and our affiliates might offer; (g) information about past purchases or experiences at Wendy’s; and; (h) information you enter into our system when using the Mobile App, such as contact information. We may also use the information you provided us, in accordance with applicable laws, to contact you from time to time to provide you with important information, required notices, and marketing promotions.

    The information that you provide will be synchronized from time to time between our website and the Mobile App so that you may have access to that information from multiple devices.
    Information We May Collect through the Mobile App Subject to the functionality of a particular Mobile App, we may also collect additional information through your use of a Mobile App, including: (a) your mobile phone number; (b) any name you might have assigned to your device; (c) your contacts/address book; (d) your web browsing history; (e) information concerning other apps you have downloaded or used; and (f) other stored information on your device such as videos, photos, photo location, audio, calendar, passwords, dialer, microphone, and/or social network credentials. We may use information collected through the Mobile App as specifically indicated in the Mobile App, as well as to assess the performance of our Mobile App or other online services, prevent fraud, provide technical support, conduct research, generate analytics, address internal online services operations, and/or respond to your needs.
     
    Device Data If you use different devices (such as your home computer, laptop, mobile device and/or other smart device) to access the Mobile App or our website, we may be able to associate you with each of your devices.  For example, we may recognize your My Wendy’s account across devices.  Information we have collected from your different devices may be combined with other information you have provided us, including information that is saved in your My Wendy’s account, your order history, how you use our Mobile App and website, and the products you view.  We may use this information to help provide more tailored experiences and consistent services across all of your devices.  We may also use this information to prevent fraud, such as by identifying when your account is accessed from an unfamiliar device, or to provide customized offers or advertising based on your use of each device and your interactions with the Mobile App.  To opt-out or cancel this device tracking, you may cancel or delete your My Wendy’s account information.If you use different devices (such as your home computer, laptop, mobile device and/or other smart device) to access the Mobile App or our website, we may be able to associate you with each of your devices.  For example, we may recognize your My Wendy’s account across devices.  Information we have collected from your different devices may be combined with other information you have provided us, including information that is saved in your My Wendy’s account, your order history, how you use our Mobile App and website, and the products you view.  We may use this information to help provide more tailored experiences and consistent services across all of your devices.  We may also use this information to prevent fraud, such as by identifying when your account is accessed from an unfamiliar device, or to provide customized offers or advertising based on your use of each device and your interactions with the Mobile App.  To opt-out or cancel this device tracking, you may cancel or delete your My Wendy’s account information.

  2. HOW WE SHARE PERSONAL INFORMATION

    Subject to applicable laws and the terms of our Privacy Policy, we may share your usage of Mobile Apps and/or your personal information with other entities, including operating systems, carriers, platform providers, social media networks, service providers, suppliers and other third parties (including our gift card service providers to process payment transactions and to support Wendy’s gift card products), legal and law enforcement, Wendy’s independently-owned franchisees, our affiliates, the rest of our owned and operated websites, and/or other mobile apps either operated by us or third parties, as well as any other entities described in our Privacy Policy or any particular Mobile App.
     

  3. AUTOMATIC DATA COLLECTION AND ADVERTISING

    Some online services, including Mobile Apps, may be supported via advertising and may collect data to help the online service serve ads. We may work with analytics companies to help us understand how the online service is being used, such as the frequency and duration of usage. We may work with advertisers and third party advertising networks and share how you interact with advertising provided in the online service to help us reduce or eliminate the cost of online services. We may also work with consumer data resellers that buy and/or sell information to other companies for multiple purposes including offering products and services that may interest you.     Your information may be obtained by other third parties, such as your mobile device manufacturer or carrier, mobile or data network systems or operators, other providers of other mobile apps or code on your device, and anyone who has administrative privileges to devices you use. In general, we do not control what information those kinds of third parties may receive and do not take any affirmative steps to provide them with more information than they would be able to obtain from other mobile apps you might choose to download.

     

  4. ACCESS AND OPT-OUTS

    Where required by applicable law, we provide online visitors with access to personal information they provide through the online services and the ability to review, update and correct that information as and when necessary. To help protect your privacy and security, we will take reasonable steps to verify your identity, such as requiring a password and user ID before granting access to your personal information.

    In addition to the options provided by your mobile operating systems, you may opt-out of processing of personal information on Mobile Apps and other communications as follows:

    • Uninstalling the Mobile App – You can stop all collection of information by the Mobile App simply by uninstalling the Mobile App. You may use the standard uninstall processes as may be available as part of your mobile device or via the Mobile App marketplace or network.
    • Opt-out of Emails or Newsletter– You may unsubscribe from emails sent by us as indicated in the particular communications you receive from us.
